Important Information About Your Waste Collection & Related Services

1. Service Overview

Our waste collection and related services (“Services”) are provided based on availability and operational conditions. Unless you are bound by a commercial agreement, you may stop service at any time.

When you schedule a pickup, we will arrive on the arranged service day. While we strive for consistency, weather, equipment issues, road closures, and other unexpected factors may occasionally shift timing.

We do not promise an exact pickup hour. Collections occur during our standard operating window, and timing may vary. If we are unable to reach you on your scheduled day, we will reattempt service as soon as reasonably possible.

For timely pickup:

Residential waste must be placed out by 7:00 AM
Commercial/multi-unit waste must be placed out by 6:00 AM

2. Compliance With Local Regulations

All waste must comply with your municipality’s disposal rules. Items that are prohibited, incorrectly sorted, dangerously packed, or unsafe to collect may be left behind. We reserve the right to refuse items or cancel service if waste poses safety or compliance issues.

3. Service Limitations & Right to Refuse

We may decline to collect:

Overloaded bags/containers
Items outside the scope of your plan
Hazardous or restricted materials
Waste that is unreasonably heavy or unsafe

If service misuse occurs (e.g., hiding construction debris in household bags), we may discontinue service without refund. Notes or courtesy messages may be left when items are refused.

If a dispute arises and we are found responsible, our total liability is limited to one day of service fees or $20, whichever is lower.

4. Liability & Customer Responsibilities

You agree to keep the collection area clear of vehicles, obstructions, and hazards.

We are not responsible for:

Damage caused by bags placed next to delicate or valuable property
Property damage resulting from access to bins or collection areas
Weather-related issues, pests, or animals disturbing waste prior to pickup

You agree to indemnify and hold us harmless from any property damage claims arising around your pickup area, regardless of cause.

If you believe damage occurred, it must be reported in writing within 24 hours.

We are not liable for lost profits, inconvenience, indirect damages, or any form of consequential loss.

If your garbage is placed out late and we miss it, we cannot refund the visit. We will attempt to accommodate a courtesy return only if possible.

5. Account Management, Billing & Cancellations

Residential (Non-Contract)

Monthly customers may cancel anytime before the next scheduled pickup.
Annual customers may cancel anytime, with unused service refunded based on the current monthly rate.
If a pickup occurs within the billing period, the full month is billable.

Refunds are processed in 7–10 business days.

Commercial, Condo, and Multi-Unit Accounts

For customers under contract, the contract terms apply in addition to these conditions.

Early termination is not permitted; remaining contract value becomes payable immediately and may be charged automatically.

Late or Missed Payments

Accounts must be paid by the first of the month.

Overdue accounts may be paused until cleared.

Suspension of service does not cancel your remaining obligations.

6. Items Not Accepted

These cannot be collected through regular garbage service. Some may be accepted through a pre-arranged junk removal appointment:

Not permitted in regular pickup:

Soil, tree cuttings
Construction debris, drywall, bricks, concrete
Chemical waste, oils, fuels, solvents
Explosive, pressurized, or flammable items
Medical or biohazard waste
Sharp objects or syringes
Tanks, cylinders, or cartridges
Hazardous or regulated materials of any kind (ie. batteries)

Tires incur an additional handling fee of $25 each.

Unapproved items discovered in your set-out will be left behind. Partial service does not qualify for partial refunds.

7. Dispute Resolution

If a dispute arises between you and the company, both parties agree to resolve the matter through arbitration governed by Canadian commercial arbitration rules. Any decision reached by the arbitrator may be filed in a court of competent jurisdiction.

We reserve the right to choose either arbitration or a civil/small claims proceeding in Ontario for matters we initiate.

If arbitration is selected, all associated costs will be your responsibility.

8. Communications

By enrolling in service, you consent to:

Email notifications
Service reminders
Operational updates
Text messages related to pickups, billing, and promotions

Standard carrier messaging fees may apply. If you opt out of electronic communication, you may not be able to use our services.

9. Equipment, Bins & Containers

If we provide bins or containers:

You are responsible for keeping them in good condition
Damage beyond normal wear may result in repair or replacement charges
Lost, vandalized, or modified bins may be billed at full replacement value

Bins will be inspected after service ends, and assessments may take up to 90 days.

10. Payment Issues, Chargebacks & Collections

If payment fails, we will contact you. If the account is not settled within 7 business days, the following may apply:

Interest at the maximum rate permitted by law
A $75 monthly administrative fee
Suspension of service

Chargebacks filed for validly delivered service may result in a $1,200 administrative fee to cover investigation and processing costs. Accounts may be forwarded to collections and may be reported to credit agencies.

In cases of non-payment, you agree that we may return waste of equivalent value/volume to your property without notice. You release us from liability related to the return of such material.

11. Governing Law

These Terms & Conditions are governed exclusively by the laws of Ontario.

Sections relating to liability, limitations, disputes, payments, and indemnity survive any cancellation or termination of service.
